Whistleblowing and sexual harassment

Whistleblowing is when a worker discloses wrongdoing by their employer.

Workers who do this are protected by the law from unfair dismissals or other kinds of detriment, but only if:

  • They follow certain rules when disclosing the information.
  • The disclosure is about one or more of the following matters (that's either happening now, took place in the past, or is likely to happen in the future):
    • A criminal offence
    • The failure to comply with a legal obligation
    • A miscarriage of justice
    • A danger to the health or safety of any individual
    • A danger to the environment
    • Deliberate covering up of information tending to show any of the above 5 matters

From 6 April 2026, this list is set to include any disclosure of sexual harassment that has occurred, is occurring or is likely to occur.
